Subject: Gym Contract Legality
"Should I fail to make payments on the date they are due within my contractual period, or fail to pay one complete calendar months membership after notifying the club of my intention to cancel in accordance with clause 6 overleaf, I understand that my signature below gives [gym name] the full authority to debit my nominated credit/debit card, details of which are shown below. I have read and understood the above."
The 1 calendar month bit I am assuming applies to rolling contracts after the initial 12 month contract (although that is not explicitly outlined anywhere).
Account number and sort code are then listed below that as part of the DD Instruction.
Clause 6.3 is basically you may not cancel your contract during the Initial Term (the 12 months) unless you provide us with a doctor's medical certificate or letter confirming redundancy from my employer.

I'm not sure. Some of our customers in the past (call centres) have charged an end users debit card with the cost of the handset if they refuse to return it.

did you actually give them debit/credit card details as well as direct debits details?
If so it sounds it sounds like they'll have a go at taking it from there.
Otherwise they'll never get it because it isn't worth the cost of court. They might get collectors to hassle you and destroy your credit rating though

They've only got acc number and sort code from the DD. Not the rest of the card details. I would quite like to keep my credit rating though, it's pretty alright.
On second thoughts they very likely don't have the ability to register a default on credit files - they're not a finance company after all - unless the deal was technically a loan instead of a subscription.
If they don't actually have the full card number and expiry date and you've canceled the direct debit they can't get any money off you unless you let them. Depends on how nasty the thugs with dogs are they send round

Are robnob's last log ins. My theory: he didn't pay the rest, the gym started a law suit, robnob still refused to pay and went to jail between 03.31 and 11.04

Gym passed the debt onto a debt credit management company, ACR Europe, although didn't inform me as such. Did some digging on Internets and they seem to be LA Fitness' choice of cowboys. They don't seem to actually do anything except send letters and make phonecalls.
Eventually ACR passed it onto Trevor Munn solicitors, which turns out to be ACR's in house legal team. Again they don't seem to do much except send letters. But I didn't fancy risking anything so sent a cheque to LA Fitness for the sum that they last quoted to me in their last correspondance, £79.95, ignoring the various charges ACR and Trevor Munn were trying to pass on to me. Got a letter back the other day saying thanks that now brings the arrears down to £39.95.

This is so much fun... not, told you in the first post "...I would suggest you try to settle amicably (with the gym)" would have cost you much less!
I'm pretty sure it would have cost me the same. I'm not paying and of the fees the third parties have tried to levy, only what LA Fitness are saying I owe as part of the contract/late fee.
