I wish to inform you of a scandal which is unfolding in the Romanian First League as this may be of some interest to you.
Politehnica Timisoara is currently facing the risk of losing the right to bear its name, colours, emblem and history, as several ambiguous and controversial sports court decisions have deemed they all belong to an Italian businessman. The story is long and complex and I have therfore translated a rather precise article about the current state of things. The Romanian Football Federation is trying to fix a problem it has caused itself.
One and a half months ago, the football club Politehnica Timisoara celebrated 85 years from its creation. A question lingers in everyone minds though: who should celebrate this tradition and these honours, even if they include only two Romanian Cup – trophies?
The Italian Claudio Zambon claims to be the rightful owner of the club’s history and he has a decision from the CAS to prove it. Yet, SC Politehnica 2002 SA Timisoara is the true descendant of the “historical” team. Probably if FCU Politehnica Timisoara, owned by Marian Iancu, had not “climbed up the ladder”, this scandal would not have come into existence.
Zambon disclaimed Poli in 2001
It is interesting to see how the Italian managed to mislead everyone, from Timisoara supporters to the Romanian football officials. On the 30th October 2001, Zambon decides that ICS Sport Management (his company) ceases to finance Poli. One week later, the contract between the Italian and the Timisoara City Hall representatives is scrapped. Moreover, on the 18th of February 2002, the business man makes the Football Federation aware that he is withdrawing the financial support for Poli. “I am sick of Timisoara! I don’t care about it any more. It’s up to you how you handle the situation. I brought you back from Divizia C (third league) once, now I want to see how you can deal with it all alone!” Zambon was saying at the end of July 2001.
Up to this point in time there is only one Politehnica. The “viola” team was in the middle of the season when Zambon retreated from the club. Therefore Andrei Constantin, Zaharia Gheorghiescu, Alexandru Dumitrescu and Adrian Craciun took over the reigns of the team. The four founded in March 2002 SC Politehnica 2002 SA and Andrei Constantin was granted authority from a majority of the club’s founding members to be the rightful successor of the team founded 1921.
Poli 2002 SA, acknowledged by the Romanian Football Federation
Once founded, the new society is sued by Claudio Zambon in order to be dissolved, on the ground that the founding members and their association did not exist any more. The court ruled in favor of Politehnica Timisoara 2002 SA and its founding members - the rightful possessors of the club history. The RFF confirms this “According to art. 44 from the Bill 69/2000, we inform you that your affiliation to the RFF as a descendant of ASFC Politehnica Timisoara has been approved” in an article signed by Adalbert Kassai.
At the end of the 2001-2002 season, Poli relegates to the third division with a penalty of -33 points. Andrei Constantin contacts the RFF anew, stating the club’s financial problems and withdrawing it from the 2002-2003 season. In this one-season period, only the youth teams of Politehnica Timisoara were active. Hexe Jebel took up the free third division spot for a year and after it relegated, it waived its fourth division place in favor of Politehnica Timisoara 2002 SA.
At the same time, just before the start of the 2003-2004 season, Zambon registers Politehnica Timisoara SA for the County Division at the Regional Football Association, the organization being in the process of registering to the Registry of Commerce (registration was completed on 13th September 2004). The fourth league spot offers the Italian the ability to obtain the certificate of “sportive identity”. With the SA (joint-stock company) and the name Politehnica Timisoara, Zambon buys a third league place at Dragasani, where the team plays during the 2003-2004 season. Now Zambon had everything he needed to regain the club’s history, the one which he had abandoned in November 2001. Based upon the same mandate which had confirmed Politehnica Timisoara SA 2002 as the club descendant of ASFC Politehnica Timisoara, the Italian businessman received a similar document from the RFF. It is interesting to note that the officials from the “House of Football” did not demand the signatures of the founding members from Zambon, knowing that the same mandate had been used in the case of Poli 2002 SA a year ago.
Now there were two organizations claiming the history and records of Politehnica Timisoara: SC FC Politehnica 2002 Timisoara SA and SC FC Politehnica Timisoara SA. Just before the 2002-2003 season, AEK Bucharest, owned by Anton Dobos, moves to Timisoara, thus giving birth to a third “Poli”. The supporters did not realize at that time what implications this move had. Slowly, the leaders of the team’s supporter groups gathered evidence and drew the owner’s attention to the matter. In February 2004, Politehnica AEK Timisoara is taken over by Balkan Petroleum, Marian Iancu being the company’s president. The amounts invested into the team attracted Zambon’s attention who claimed at that time that his team, “the real Politehnica Timisoara”, will gain promotion from the second league and move to play again in Timisoara, on the Dan Paltinisanu Stadium, “there where it belongs”.
The Polytechnic University owns the brand “Politehnica”
Under pressure from supporters, Marian Iancu tried to buy off the records from the Italian, who agreed to sell the club’s history – for one million euros. In the second half of 2006, Marian Iancu’s team transforms into a joint-stock company. With the new organization, SC FC Politehnica Timisoara Invest SA, Marian Iancu tries to regain the club’s history. The first step was done as he took over Poli 2002 SA, Andrei Constantin becoming a shareholder of FC SC Politehnica Invest SA.
In December 2006, the Court of Arbitration for Sport decides in Zambon’s favor in the matter of the club’s history, and interdicts Politehnica Timisoara Invest SA the use of the name, emblem, colors and anthem of Politehnica Timisoara SA. What the CAS was not aware of is that the brand name “Politehnica” is registered at OSIM (Romanian State Office for Inventions and Trademarks) by the Polytechnic University of Timisoara, which is also shareholder in FCU Politehnica Timisoara Invest SA. The University has given its written consent for the use of the brand by FCU Politehnica Timisoara. In addition to this, the CAS was mislead by the fact that Zambon did not inform them of the founding members withdrawing their support for his team."
In the meantime, the RFF decided FCU Politehnica Timisoara Invest were the rightful owners of the history, but CAF maintained its decision.
The fans have organized a rally for Saturday evening and they have all the support from the local authorities. Thousands of people are expected to protest non-violently in Timisoara city centre.
Please do look into this matter if you can, or at least make the world aware of what is happening. There's more than just colours and emblems at stake, it's a question of where football is going and how fair this sport has become.
