Una sentenza dello scorso marzo aveva già condannato Gawker a pagare un risarcimento di 115 milioni di dollari, ma ulteriori cause devono essere definite. La storia era diventata tema di un ulteriore e più esteso dibattito quando si era scoperto che alle spese legali di Hogan aveva contribuito un noto e ricco imprenditore del business digitale, Peter Thiel, intenzionato a mettere in difficoltà Gawker in conseguenza delle pratiche giornalistiche molto aggressive e diffamatorie del sito.
Secondo Reuters la società di Gawker è stata messa in vendita e ci sono delle trattative con la società editoriale Ziff Davis LLC: nella richiesta di stato di bancarotta Gawker sostiene che la società varrebbe tra i 50 e i 100 milioni di dollari, e che le penali che la riguarderanno possono andare dai 100 ai 500 milioni,
